Acceptable Use Policy
This policy is incorporated by reference into the Terms of Service. Breach of it is a ground for suspension or termination.
1. Purpose and scope
This Acceptable Use Policy ("AUP") sets out what you may and may not do when using Athly's Service (the AI coaching platform operated by Athly Operations Pty Ltd, ACN 696 739 027 / ABN 59 696 739 027, of Level 2/315 Brunswick St, Fortitude Valley QLD 4006). It applies to every user and forms part of your agreement with us under the Terms of Service.
We can enforce this AUP directly — including by removing content, restricting features, suspending, or terminating accounts — as set out in Section 5 and in the Terms of Service.
2. Acceptable use
You may use the Service only:
- For your own personal, non-commercial training and development
- In a lawful manner, consistent with this AUP, the Terms of Service, and all applicable Australian laws
- As the genuine account holder, using accurate registration information
3. Prohibited conduct
You must not, and must not attempt to, do any of the following.
a. Misuse of the AI coach
- Use the Service to obtain medical, therapeutic, diagnostic, psychological, clinical-nutritional, legal, financial, or other professional advice it is not designed to give (see Section 5 of the Terms of Service for the full list of what the AI coach will not do)
- Attempt to prompt, jailbreak, or otherwise induce the AI coach to give rehabilitation, injury-treatment, return-to-play, clinical mental health, or regulated dietary advice
- Deliberately prompt the AI coach to produce unlawful, harmful, defamatory, hateful, sexual, or dangerous content
- Rely on the AI coach for decisions about serious injury, illness, or mental-health crises instead of a qualified professional
- Misrepresent the AI coach's output as the personal, individualised advice of the athlete
b. Harmful, illegal, or abusive content and behaviour
- Submit or transmit content that is unlawful, defamatory, harassing, threatening, discriminatory, obscene, or that incites violence or self-harm
- Submit content that infringes another person's intellectual property, privacy, or other rights
- Impersonate any person or entity, including the athlete or Athly staff
- Upload malicious code, or content designed to disrupt or damage the Service or other users
c. Security and integrity
- Access or attempt to access another user's account or any non-public part of the Service
- Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures
- Use bots, scrapers, or automated means to access, copy, or extract data from the Service. This does not restrict your use of assistive or accessibility technology (for example a screen reader or voice-control software) to use the Service as intended.
- Reverse engineer, decompile, or attempt to extract the underlying AI models, prompts, voice models, or source code
- Use the Service or its outputs to train, build, or improve any competing AI model or product
d. Commercial and platform misuse
- Resell, sublicense, rent, or commercially exploit the Service or its content
- Share, transfer, or sell your account or login credentials
- Use the Service to send spam or unsolicited communications
- Circumvent, disable, or interfere with usage limits, billing, or access controls
e. Misuse of athlete identity
- Record, reproduce, distribute, or publish the athlete's voice, likeness, or AI-generated outputs outside the Service
- Create deepfakes, parodies, or derivative content using the athlete's voice or likeness
- Use the Service in any way that could harm the athlete's reputation
4. Age and eligibility
You must be 16 or over, and must meet the other eligibility conditions in the Terms of Service. Providing false age or eligibility information is a breach of this AUP.
5. Reporting and enforcement
Reporting. If you encounter content or behaviour that breaches this AUP — including harmful AI output — report it using the report control in the product, or email contact@getathly.com. We review every report.
Our response. Depending on the seriousness and circumstances, we may:
- Issue a warning
- Remove or restrict access to content
- Suspend or limit features on your account
- Suspend or terminate your account
- Report conduct to law enforcement or regulators where required or appropriate
- Preserve relevant records as needed for safety, legal, or regulatory purposes
We aim to act proportionately, but we may act immediately and without notice where there is a risk to safety, security, the athlete, other users, or our legal position. Termination for breach does not entitle you to a refund except as required by the Australian Consumer Law (see Section 7 of the Terms of Service).
Safety escalation. Where content indicates a risk of serious harm to any person, we may take any step we reasonably consider necessary, including contacting emergency services or relevant authorities. We maintain a documented internal safety-escalation procedure covering how such reports are triaged and actioned.
6. Changes
We may update this AUP from time to time. The current version is at getathly.com. Material changes will be notified consistent with the Terms of Service.
